HomeMy WebLinkAbout1578that of the Developer or others than Utility, with reference to such connections the parties agree as follaws: (a) Alt consumer installation connections must be inspected by Utility before backfilling and covering of any pipes; (b) Notice to Uti3ity re~u@stinq $n insgection of a~ consumer installation connection may be given by the Plumber or Developer and the inspection will be made with twenty-four (24) hours= (c) If the Developer does not comply with the foregoing inspection provisions, Utility may refuse service to a connection that has not been inspected until Developer complies with these provisions. The parties hereto further agree that the costs or expense of constructing all consumer installations and all costs and expenses of operating, repairing and maintaining any consumer installation shall be that of Developer oz others than Utility. 14. This Agreement shall be binding upon and shall inure to the benefit of Developer, Utility and their respective successors and assigns. However, in the event Developer has not paid and delivered to Utility the contributions in aid-of-construction provided to be paid Utility by Developer under the terms of this Agreement, then this Agreement shall not be sold, conveyed, assigned, transferred or otherwise disposed of by Developer without the written consent of Utility first having been obtained. However, Utility agrees not to unreasonably withhold such consent. This Agreeinent shall also be binding•upon all successors in interest of either party by operation of law. Utility is hereby granted the right to assign thzs Agreement and this Agreeii-ent shall survive the merger, sale, incorporation, ar acquisition of the System or Utility. 15. Until further written notice by either party to the other, all notices provided for herein shall be in writing and shall be mailed or delivered to Developer at: The Sands Ocean View Development 3201 North AlA Ft. Pierce, Florida 33450 with copy to: ~ Marc Lipsitz, Esquire Brittor~, Cohen, I:aufman, Berison & Schantz 100 South Biscayne Boulevard, Suite 800 Miami, Florida 33131 and, if to Utility, shall be mailed or delivered to it at: North Hutchinson Services 2901 North AlA Ft. Pierce, Florida 33450 with copy to: Myers, Kaplan, Levinson, Kenin 6 Richards Suite 103, 1020 East Lafayette Street Tallahassee, Florida 32301 16. The rights, privileges, obligations and covenants of Developer and Utility shall survive the completio*~ of the work of Util:ty with respect to completing the sewer facilities and service to any stage area and to the Property as a whole. -8- . ;'~" 351 ~~~Gt 157~
