~epresentations, either verbal or written~ heretofore in effect
between Bevel~per and Utilit~, made with respect to the matters
herein contained, and •~hen duly executed, constitutes the Agree-
ment between Developer and Utility. No additions, alterations,
or variations of the terms of this'Agreement shall be valid, nor
can provisions of the Agreement be waived by either party unless
such additions, alterations, variations, or waive~s are expressed
in writing and duly signed.
18. This Agreement shall be governed by the laws of the
jurisdiction in which the Property is located and it shall be
and become effective immediately upon execution by both parties
hereto.
19. In the event the Utility is required to enforce this
Agreement by court proceedings or by proceeding before the Florida
Public Service Commission or any other regulatory agency or other-
wise, by instituting suit or otherwise, then the Utility shall~be
entitled to recover all costs incurred including reasonable attor-
ney's fees, including reasonable attorney's fees incurred in the
event of an appea2.
20.. Subject to the termination provisions of Paragraph 7 hereof
this Agreement shall be coupled with in interest and shall run with
the Property for the benefit of subsequent owners of the Property.
The Utility shall not be obligated to perform.its obligation here-
under, however unless said subsequent owners fulfills the obligation
of the Developer hereunder, but nothing herein shall obligate a
subsequent owner from having to so fulfill Developers obligation.
