Declaratfon may have been amended by any amendments
recorded in ihe Public Records of -St. Lucie County,
Florid~ including, but not ~limited to, any. amendment to ~
add the .aforesaid Phase to the Condominium (if suct~ ~
Phase be other than Phase I thereof .
~ Grantee, by acceptatice hereof, and by agreement wlth Grantor hereby
expr~ssly assumes and. agrees to be bourrd by and to comply with all of the
covenants, tern~s, conditfons and provisions set forth and contained in the
aforedescribed Declaration of Condominium; including, but not limited Lo, the ~ i
obligation to make payment of assessments for the maintenance and operatfon -
of ~the Condaninium whic~i may be levied against the above-described Apart- '
ment: Grantee expressly acknowledges the existence of a Settletnent Stipula-
tion and Agreement for and Grant of Easements and Other Rights- (the "Setde-
ment Stip.iilation-") and a Declar~tion of Protective Covenants and Restrictfons ~'2
(the "Protective ~Covenants"), as well as the "Designation Notfce" modifying
o the Setden~ent Sttpulation and Protective Covenants, all as hereinafter set ~
forth. The Settluaeni Stipulation provides for this Condominium to be served
~ by certain facilities of High Point of Fort Pierce .Condominiwn Sect~on 1 and
the Protective Covenants provides_ for certain land ~use covenants upon the ;
land areas described ~therein (includinq, but not limited to, portions of the ~ ~
land areas included within this Condominiumj and provides for certain drainaqe ;
~.asements and other easements and rights including , but not~ liinited Lo, the ~ ~
"Roadway Easement", "Sewaqe_ Systent Rights", "Water System Rfghts" and -
"Future Development Property Drainage Easement" , all as are more particular-
ly descrfbed therein, all in acidition to the other matters set forth in the
Setilement Stipulation and Protective -Covenants, which other matters include, .
but are not limited to; the obligation Lo pay certain "Assessments" as are ~
respectively set forth in the Settlement Stipulation and f~rotective Covenants .
Grant,ee expressly acknowledges and assumes the obligation to pay ihe amounts
. assessed against the Apartment under both the ~ Setdement Stipulatfon and
Protective _ Covenants and acknowledqes that "Assessments" under both the '
Setttement Stipulation and Protective Covenants against all properties now or
hereafter included within this Condominium in accordance with . the above-
described Declaration of Cot?dominiwn are "Canmon Expenses" of this Condomin-
ium as provided for in the Declaration of Condoininium. ~
