Declaration may. have been~ amended by any amendments
~ - recerded. fn the Public Records of St. Lucie County,
~ Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such ~
~ Phase be other than Phase I thereof _ -
- Grantee, by acceptance hereof and by agreement with Grantor hereby
expressly asswnes and agrees to be bound by end to comply with all of the -
covenants, terms, conditions and prnvisiQns set forth and, contafned in the ~
aforedescribed Declaration of Condominium, including, but not limited to, the
obligation to make paya~ent of assessments ~ for the maintenance and operation
of the Condominium which may be levied against the above-described Apart-
I'~ ment. Grantee ~ expressly acknowledges the existence of a Settlement Stipula-
~ tion and Agreement for and Grant of Easements and Other Rights (the "Settle-
ment Stipulation" ) and a Declaration of Protective Covenants and Restrictions _
(the "Protective Covenants"), as weil as the "Designation Notice" anodifying
e the Setdement Stipulation and Protective Covenants, .all as hereiriafter set .
~ forth. The Settlement Stipulation provides for'this Condominium to be served
by ~ certain facilities of High Point of Fort ~Pierce Condominium Section 1 and
the Protective Covenants provides for certain land. use covenants upon the ~
land areas described therein (including, but -not 1Lnited to, portions of -the
land areas included wiihin this Condominium) and provides for certain drainage
~.asements and other easements and rights including; but not limited to, _the -
-"Roadway ~Easement", "Sewage System Rights", "Water System Rights" - and
"Future Development Property Drainage Easement" , all as are more particular-
_ ly described therein, all in addition to the other tnatters set forth in the -
Settlement Stipulation and Protective Covenants, whfch other matters include,
but are not limited to, the obllgation to~ pay certain "Assessments" as are
respectively set forth in the Settlement Stipulation and Protective Covenants .
Grantee expressly acknowledges and assumes the obligation to pay the ainounts ~
. assessed against the Apartment under both the Settlement Stipulation and
Protective Covenants and acknowledqes that "Assessments" under both the
Settlement ~ Stipulation and Protective Covenants against all~ properties now or
~ hereafter included v+rithin this Condaninium. ~in accordance with the above-
descMbed Declaration of Condocninium are "Common Expenses" of this Condomin-
iwn as provided for in the Declaration of Condominium.
