HomeMy WebLinkAbout0953 ~y ~~i%rG?9 RELEASE WHEREAS, the Florida East Coast Railway Company, a Florida corporation, herelnafter called "Railway", by Special Warranty Deed dated November 17, 1980, filed in 0. R. Book 346, Page 1946, Public Records of St. Lucie County, Florida, conveyed to Codisco, Inc., hereinafter called "Grantee", that certain parcel of real property located in St. Lucte County, Florida, as described in said deed; and WHEREAS, said deed dated November 17, 1980, contained a provision as follows: "Grantee agrees for itself and its successors and assigns, unto and with Grantor, its successors and assigns, as a covenant running wfth the land and as a part of the consideration for this conveyance, snid covenant being evidenced by the acceptance and recordation of this deed by Grantee that said premises conveyed will be utilized tor and in connection ?vith the construction thereupon of a substantial warehouse building or structure having an area of not less than twelve thousand (12,000) square feet, tor use or to be used by Grantee, in its business of warehousing and distribution of building meterials, Grantee agrees further that Grantor sha11 have and hereby reserves the rigF~t to repurchase said land and property at and for the price of ThirtyOne Thousand One Nundred Ten Dollars (~31,110.00) if within eighteen (18~ months next ensuing fro~~~ ~nd aft~er the date of thi s conveyance the 6rantee or i ts successors or assigns fai 1 to use the premises for the purpose aforesaid, or if, prior to the construction of said warehouse, during that eighteen (18) month period the land and property or any part thereof becomes sub~ect to any condemnation proceeding.
