This matter coming on to be heard on the consent of the parties,
and the parties having represented that since the filing of the
lawsuit a subsequent hearing was had before the Board of Adjustment
which resulted in the Defendant RODDENBERRY'S appeal from the
Zoning Director's decision being denied, and the Court being~
fully advised in the premises, it~is therefore
ORDERED AND ADJUDGED that:
1. This cause be, ar.d the same is hereby dismissed.
2. Nothing contained herein shall be constured as preventing
the Defendant RQDDENBERRY from re-applying in the future for a
homc occupation.
