ORDER . -~ ' ~ - . _
THIS CAUSE came on to be heard on the Motion of the Defendants to
dismiss for failure to meet the statutory injury threshold, and the Court
having heard argument of counsel for the parties, and having examined
the pleadings and evidence, finds that there is no admissible evidence
that the Plaintiff has met the requirements of Section 627.737(2),
~ Florida Statutes, and this cause should be dismissed vithout prejudice
in accordance with the provisions of the aforesaid statute, that upon
representation of counsel for the Plaintiffs additional evidence may be
forthcoming which may enable the Plaintiffs to meet the statutory
requirements and, therefore, it is
ORDERED AND ADJUDGED as follows:
1. Plaintiff shall have 15 days from the date of entry of this
Order withtn which to present to the Court and opposing counsel by
affidavit or deposition medical evidence of a permanent injury sustained
by the Plaintiff in the motor veh~cle accidEnt which is the subject matter
of this cause;
2. Upon failure of the Plaintiff to comply with the provisions of
Paragraph 1, above, this cause shall be dismissed without prejudice in
accordance with the provi~ions of the above-cited Florida Statute.
