HomeMy WebLinkAbout0155 purposes of drainage of surface water over, across and under such portians of Parcel A as are not within the "RuildinQ Area" shown on the Site Plan and use oE any drainaRe facilities naw or hereafter constructed upon or under Parcel A. The aforesaid right to drain surface water over, ~cross and under Parcel A shall he timited to and in accordance with that certain drainage plan attached hereto as Exhibit •'C" and the owner of Parcel A aRrees that it shatl not change such drainage plan (or the configuration or topography of Parcel A as shown thereon) in such a way as will si~nificantly adversely affect the right of the owner of Parcel B to drain its surface water in accordance with such drainaRe plan. 2. General does hereby establish for the benefit of, and grant and convey to, the owners from time to time of Parcel A and such owners'• tenants, and the customers, employees and invitees of such owners and tenants, a non-exclusive easement appurtenant to Parcel A, for the following purposes: (i) passage and use for M~alkin~ upon and driving and parking vehicles upon, over and across all those sidewalks, entrances, service drives, access roads, lanes and parkin~ areas on Parcel B which are now or may hereafter from ~ tir-e to time be used for pedestrian and vehicular traffic and parking; (ii) usinR all "Consumer Facilities.," as hereinafter defined, that may exist from time to time on Parcel B; (iii) drainage of surface water over, across and under such oortions of Parce2 B as are not within the "Ruilding Area" shown on the Site Plan and use of any drainage facilities now or hereafter constructed upon or under Parcel B; (iv) use of any water retention facilities now or hereafter located on or under Parcel B and located within that portion of Parcel B shown shaded or crosshatched on Exhibit "D" attached hereto; and ~v) installation, use, maintenance and repair of underground utilities serving any portion of Parcel A over, across and under such portions of Parcel B as are not within the "Building Area" shown on the Site Plan.
