(j) aiggins, as owner of Parcel A, a3rees that
for so tong as Ecker~ Drugs of Florida, Inc., or any
parent, subsi3iary, affiliate, or affiliate~
corporation or assignee thereof, operates a~rug store
within any portion of the im~rovements located on
Parcel 3, na i~provements on Parcel A shall be use3
for the operation of a~rug ~rescription department
requiring a registered pharmacist.
5. :'he parking lots, sidewalks, driveways, service drive~,
access r~ads, drainage facilities and water retention facilities now
or hereafter located on any of the Parcels shall be maintained in
goo~ or~er and repair by the respective owners of s.uch Parcels at
all times during the term of this Declaration, inclu~ing snow, ice
aad trash removal. At any time an3 from time to time ~uring the
term of this Declaration, the ~wner from time to time of~Parcel A or
Parcel B(but not Parcel C) an~ such owi~er's tenants shall have the
right, but not the obligation, to enter upon the other parcel (~i.e.
Parcel A or Parcel B, but not Parcel C) for the ~urpose of
maintaining, repairing an~ replacing those certain access roads,
~rive~~afs, service drives, entranceways, curbs, parkin~ areas an3
sidewalks located on the other parcel which are shown sha~s~ on the
Site Plan an9 for the purpose of maintaining, repairing an~
replacing all 3rainage facilities an3 water retention faci2ities
locate~ upon the other parcel. In the event that the owner ~f any
parcel enters upon another parcel to install, maintain or repair any
utility line as provi3e3 in Paragraphs 1, 2 an3 3 hereoF, such work
shall be ~one expe~itiously an~i in a goo:i and workmanlike ~anher,
and the area affected shall be promptly returned t~ the same
c~n3ition as existed prior to such work. Such work sha11 be carrie3
