transfer all or any part of the Cownon Area to any public
agency, authority~ or utility for such purposes and subject
to such conditions as may be agreed to by the members.
No such dedication dr transfer shall be effective unle$s an
instrument signed by two-thirds (2/3) of each class of inembers
agreeing to such dedication or transfer has been recorded.
(d) The right of individual Owners to the exclusive
use of parking spaces as provided in this Article..
Section 2, Dele ation of Use. Any owner may
delegate, in accordance wi~ the By-Laws~ his right of en~oyment
to the Common Area and facilities to the members of his
family, his tenants, or contract purchasers who reside on
the property.
Section 3. Parkin~ Ri ~ht_s., Ownership of each
Parcel shall entitle t~e Owner to the use of not more than
two (2) automobile parking spaces in the Common Area, which
shall be as near and convenient to said Parcel as reasonably
possible, together with the right of ingress and egress in.
to and upon said parking area. The Association shall permanently
assign the two (2) vehicle parking spaces for each Parcel.
Section 4. Service Easement. A perpetual right
of ingress to and egress from each Parcel and each Townhouse
is hereby granted over such portions of the Property, includ-
ing Common Area, as may reasonably be necessary for repair,
maintenance, delivery, utilities, trash pickup and fire
protection services, police and other authorities of the law;
United States mail carriers, representatives of utilities
and holders of valid mortgage liens on any of the Parcels.
Section 5. Maintenance Easement. An easement is
hereby granted, create~ and esta~is~ce in favor of the
Association, through its duly authorized agents, employees
and contractors. in. to, over and upon all portions of the
Parcels and Townhouses, for the purpose of performing such
maintenance, duties and obligations as may be authorized
and delegated herein, or exercising such rights and privileges as
may be conferred upon the Association herein.
Section-6. Other Easements.
- (a) Pre-existing easements for installation and
maintenance of ut•ilities, sewage and drainage facilities as
may be shown on the recorded subdivision or other public
records are hereby ratified and confirmed.
(b) Easements as may be declared or inferred
from the Party Wall provisions o~herwise contained herein
are hereby ratified and confirmed.
~ (c) In the event any Owner desires to avoid the
necessity of constructing a television antenna for a Townhouse,
there shall be an easement in favor of each Owner, his successors,
assigns, and grantees, for the purpose of providing connection
with and maintenanc~e of a cable television system over such
portion of the Property as may reasonably be necessary to
install and maintain such a cable system. The foregoing
easements are granted and reserved subject to the condition
that their use and enjoyment shall not interfere with the
use, occupancy, or enjoyment of all or a~y parts of the Parcels
servient to them or to which they are appurtenant.
