SEPARATIUN AND PROPERTY SETTLEMENT AGREEMENT

This agreement made this ~~~ day oi ~i-~Q~. 1980,
by and between NICHOLAS P. BERISH. hereinafter ca`lled Husband and
HELEN ELIZABETH BERISH, hereinafter called Wife.
W I T N E S S E T H
WHEREAS, the parties were married to each other on April
22, 19??, at Delray Beach, Florida and they lived as Husband and
Wife until their separation on April 15,'1980. There were no child-
ren born of the marri.age and none are expected.
WHEREAS,in consequenee of disputes and irreconcilable dif-
ferences-the parties have ~ea.sed to cohabit as Husband and Wife, and
have decided to live separate and apart for the rest of their lives,
and
WHEREAS, the parties desire to settle their respective
property rights and other rights and obligations grown out of the
marriage relationship, and
WHEREAS,~both•parties fully understand all the provisions~
of this Agreement and believe them to be fair, just, adequate, reason-
able and in the best of interest of each of them, and accordingl.y accept
such provisions voluntarily and freely;
NOW THEREFORE, in consideration of mutual promises, coven-
ants, and undertakings hereinafter set forth, it is agreed by and
between the parties as follows:
1. EFFECTIVE DATE. This Agreement shall become binding upon
the parties hereto as of the date it is signed by both the Husband
and Wife.
2. SEPAftATION A~ND NONINTERFERENC~. The parties shall at all
times hereafter live separate and apart, free from interferences,
authority or control, direct or indirect, by the other as if he or
she were single and unmarried. Neither shall molest the other, nor
compel or endeavor to compel the other to cohabit with him or her,
nor shall either party threaten the other or make accusations publicly
