WITNESSETH: That Grantor, for and in consideration of ~the sum of TEN (510.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, ~nd sold to Grantee and Grantee's heirs and assigns forever the following described real property situated, lying and being in St. Lucie County, F1orlda, to wit: ;•The Condominium Parcel known as Apartment 1015D of Phase X of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II (the "Condominium") according to the Declara- tion of Condominium thereof, recorded in Official Records Book ~30.4 at Pages 1396 throuqh 150g of the Public Records o~ St. Lucie County, Florida as such Declaration may have been amended by any amendments . thereto hereto filed in the Public Records of St. Lucie County, Florida including, but not limited to, any amendment Lo add the aforesaid Phase to the Condolniniwn (if such Phase be other than Phase I thereof). Grantee, by acceptance hereof, and by agreement with Grantor hereby expressly asswaes and agrees Lo be bound by and to comply with all of the covenants, terms, conditions and provisions set forth and contained in the aforedescribed Declaration of Condominium, including, but not limited Lo, the obligation to taake pa~en~ of ~ssessments for the maintenance and operation of the ~Condominium which may be levied against the above described Apart- ment. Grantee expressly acknowledges the existence ~ of a Settlement Stipula- tton and Agreement for and Grant of Easements and Other Rights (the "Setde- ment Stipulation" ) and a Declaration of Proteetive Covenants and Restrictions (the "Protective Coveriants"), as hereinafter set. forth. The Settlement Stipu- lation provide~ for this Condominium to be served by certain facilittes of High -Point of Fort Pierce Condominium Section 1 and the Protective Covenants provides for certain land use covenants upon the land area~ described therein (including, but not limited t,o, portions of the land areas included within this Condominium) and provides for certain drainage easements and other ease- ments and rights including, but not limited to, the "Roadway~ Easetnent", "Sewage System Rights" ,"Water System Riqhts" and "Future Development' Property Drainage Easement", all as are more particularly described therein, all in addition to the other matters set forth in the, Settlement Stipulation and Protective Covenants, which other matters include, ~but are not llmited to, the obliqation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulatlon and Protective Covenants .
