This cause coming on before the Court upon Motion for Judgment
on Pleadings and it appearing by Sworn Affidavit and the verified Petition
that the rights of the defendants have been satisfied and the same is
confirnied by an instrutnent executed by MARIO RASTRELLI having attempted
to convey his rights to the petitioner and the defendants having been
served duly and-acdording to law by publication, and the Court being
fully advised therein, thereupon, it is hereby
CONSIDERED, OImEREO and ADJUDGED:
1. That the plaintiff, DAVID P. BIESCHKE, be and he is hereby
declared to have a superior title to any and all persons named in this cause.
2. That as against the defendants, MARIO RASTR~LLI and ANN B.
RASTRELLI, his wife, and property described as:
Lot 77 less the East 20 feet thereof, and all of
l.ot 78, PARIaIAY PLACE, a subdivision accord9ng to
the plat thereof as recorded in Plat Book 4; Page
7, public records of St. Lucie County, Florida
the fee simple title to said property is hereby quieted and confirmed
in the plaintiff as to the defendants herein and that the said defendants
, ,
abovenamed are hereby forever barred from any claims adverse to the petitioner.
3. That certain mortgage and riote secured dated August 20, 1970
and recorded in O.R. Book 186, Pages 1609-1611, public records of St. Lucie
County, Florida, be and the same is declared satisfied in full.
