TO THE DECLARATION OF CONDOMINIUM FOR
SEASCAPE I CLUSTER - PHASE (C)
THE FIRST NATIONAL BANK OF CHICAGO, a national bankirg
association (hereinafter referred to as "Mortgagee"), the owner and holder of a
Mortgage (the "Mortgage") recorded in Official Records Book 299, at Page 991, and
as modified by Modification of Mortgage recorded in Official Records Book 332 at
Page 1738 of the Public Records of St. Lucie County, Flocida, whieh Mortgage
encumbers lands in St. Lucie County, Florida, including the pareel particularly
described as SEASCAPE - PHASE (C) to the Declaration of Condominium of
"SEASCAPE I CLUSTER - PHASE (C)", a Condominium, hereby joins in the making
of said DecLaration of Condominium of "SEASCAPE I CLUSTER - PHASE (C)", and
agrees that the lien of the Mortgag~ shall, with respect to the pareel deseribed on
SEASCAPE - PHASE (C) and attached hereto as Exhibit "A," be upon all of the
Units of "SEASCAPE I CLUSTER - PHASE (C)", a Condominium, together with all
of the appurtenances thereto, including, but not limited to, common and limited
common elements.
The execution hereof by Mortgagee is for the sole purpose of consenting
to the making of the Declaration of Condominium, as such consent is required by
Florida States, Chapter 718, and nothing contained herein shall be construed as
subordinating the Niortgage to any lien rights or other provisions of ~the Declaration
of Condominium of "SEASCAPE I CLUSTER - PHASE (C)", a Condominum, or the
Exhibits thereto, nor shall the exeeution hereof by Mortgagee impose upon
Mortgagee any obligations which might be contained in the Deelaration of
Condominium and Exhibits thereto, nor shall the execution hereof affect the lien or
priority of the Mortgege. The ~xecution hereof relates only to the parcel described
on said Exhibit "A" attached and does not relate to any additional land that
subsequently may be added to "SEASCAPE I CLUSTER," a Condominium, pursuant
to provisions of the Declaration of Condominium and Florida Statutes, Chapter
?18. Nothing contained herein shall affect the lien or priority of the lien of the
Mortgage with respect to the lands which ace encumbered by the Mortgage, but
whieh are not included within the psrcel described on Exhibit "A" hereto.
