necessary to retain the services of an attorney, then the
prevailing party will be entitled to recover all reasonable
attorney's fees and costs, including costs of litigation
and attorney's fees for appeals.
10. TAXES AND UTILITIES: The Lessee shall be responsible,
in addition to the rent payments and repair and maintenance
of the premises, for the payment of ad valorem real estate
taxes, assessments and for utilities. The Lessor will
notify the Lessee each year when he receives the tax bill
for the ad valorem real estate taxes and the Lessee shall
promptly remit the payment for said taxes to the Lessor.
11. RENT TO BE PAID: The Lessee shall pay to the
Lessor as rent for the premises commencing on April 10, 1981
through March 31, 1983, the sum of Six Hundred Dollars
($600.00) per month, the fir.st due in April actually being
made upon the execution of this lease. At the expiration of
two (2) years commencing on April 10, 1983 and going through
March 31, 2001,•the rent payments shall increase to the sum
of Three Thousand One Hundred SixtyNine & 60/100ths Dollars
($3,169.60) per month.
12. OPTION TO PURCHASE: The Lessee is hereby granted
from the Lessor, an option to purchase the premises as
described. This option cannot be exercised prior to April
1, 1988 and can be exercised at any time after that date by
the Lessee giving six (6) months prior written notice of his
intention to exercise said option to the Lessor. The purchase
price of the property including any improvements will be Two
Hundred Eighty Thousand Dollars ($280,000.00) and i~ said
option is exercised, the Lessee will be g:iven credit toward
the purchase price, all rents paid after April 1, 1983, less
twelve percent (12$) of said rents, for which the Lessee
will not receive credit. Upon the payment of the balance
