5. FRANK SCAGLIONE, whose address is 104 Lindemann Avenue^
Groton, New York, and DONALD SCAGLIONE, whose address is 479 Main
Street, Etna, New York, and who are qualified under the laws of
the State of Florida to serve as personal representatives of
decedent's estate, are entitled to preference in appointment as
personal representatives because they are the sons of the decedent,
have been appointed as domiciliary personal representatives in
accordance with decedent's Last Will and Testament, and are sole
beneficiaries of decedent's estate.
6. Domiciliary probate proceedinqs are known to be
pending in another state. Letters have been issued by
Surrogate's Court, County of Tompkins, State of New York, to ;

7. The nature and approximate value of the assets in this ~
estate subject to probate in the State of Florida are: a certain
piece or parcel of land, located in the County of St. Lucie,

Lot 10, Block 462, of PORT ST. LUCIE SECTION 26,
a Subdivision according to the Plat thereof, recorded
~ in Plat Book 14, Page 4, of the Public Records of
~ St. Lucie County, Florida. ~

8. Petitioners are unaware of any unrevoked will or
.codicil of decedent other than as set forth in paragraph 9.
