HomeMy WebLinkAbout20941 g o-'f 9 S cY., S~"~~85 YARTIAL RELEASC OF MORTGAGG L1EN WHEREAS, HUTCHINSON 1SI.AND LIMITED, INC., r~ Delaware corporstion authorized to transact business in thc State of Floridn, hereinaftee called "yiortgagor," by the following descrihed documents granted and conveyed unto THE FIRST NATIONAI, BANK OF CHICAGO, a national b~nking association, hereinafter called "1~Iortgagee" and its assigns, the premises and property therein particulurly described to secure the payment of the sum of money hereinafter mentioned with intecest thereon: 111ortgage given by HUTCHINSON ISGAND LIMITED PARTNERSHIP, us Mortgagor, in favor of THE FIRST NATIONAL BANK OF CHICAGO, as Mortgagee, dated December 4, 1978, and filed in Official Record Book 2 9~ at Pnge 992, in the Public Records of St. Lucie County, Florid~, in the original amount of Twelve Million Dollars (~12,000,000.00), and as modified by Modifieation of Mortgage dated June 2, 1980, and recorded in Official Records Book 332 at Page 1738 of the Public Records of St. Lucie County, Florida, wherein HUTCHINSON ISLAND LIMITED, INC. assumed the indebtedness secured by said 1-'lortgage, and increased the indebtedness to the principal sum of Thirteen Million Dollars (a13,000,000.00), together with an Assignment of Leases, Re~ts and Profits recoeded in Official Record Book 299, at Page 1002, ~nd UCC-1 Financing Statement recorded in Official Record Book. 2 9~ at Page 1008, all of said documents filed in the Public Records of St. Lucie County, Florida, and in addition, n UCC-1 Financing Statement filed with the Secretary of State, State of Florida, on December 7, 1978, under File No. 966909, between said parties; and ~VHEREAS, the said ~iortgage has cequested the s~id Mortgagee to release the premises and other property hereinr~fter described, being a Qart of said 1~lorigage, and encumbered Qremises, from the liens and ~~peration of said <<ortgege and other liens; NOtiY, 'I'fIEREFORE, KNO~i' Y~, that tt~e said 'Aortgagee, in considera- tion of the premises and the sum of Ten Dollars (~10.00) and other good and vAluable considerutions to it in hand paic~ by or on behalf of the said mortgagor at the time of the execution hereof, the receipt whereof is hereby aeknowledged, does remise, celease, quit-claim, exonerate, and discharge from the liEn and operation of said ti~iortgage and other liens referred to above unto the suid 1~iortaagor, its successors und us~igns that certain portion of the- premises conveyed by said lriortgage, and other liens referred to above more particuiarly described as follows: Condominium Parcel No. 4281, SEASCAPE I CLUSTER - PfIASE (B), a Condominium, according to the Declaration of Condominium recorded September 11, 1980, in Official Records liook 338, at Page 1033, of the Publie Records of St. Lucie County, Florida, and any amendrnents thereto. TO HAVE AND TO HOLD the same, with the appurtenanees, unto the said ti9ortgagor, its successors and assigns forever, freed, exonerated and discharged of and from the lien of said 14ortgage and every part thereof; provided always, nevertheless that nothing herein contained shall in anywise impair, alter or diminish the effect, lien or encumbrance of the aforesaid Mortgage and other liens referred to above on the remaining property of said mortguged premises, not hereby released therefrom, or any of the rights und remedies of the holder thereof.
