THIS INDENTURE, made this 6th day of January , 19 81, between
HIGH POINT EQUITIES, INC. , a F~orida corporation, hereinafter referred to
as "Grantor", and Kenneth R. Kav and Marth~ J. Kav. his w~'e ,

WITNESSETH:
That Grantor, for and in consfderation of the sum of TEN (t10.00)
DOLLARS and other good and valuable consideration paid by Gran~ee, the
receipt of which is hereby acknowledged, has granted, bargarined, and sold to
Grantee and Grantee's heirs and assigns forever the following described real
property situated, lying and being in St. Lucie County, Florida, to wit:
The Condominium Parcel known as Apartment 1204-Aof
Phase X~ of HIGH POINT OF FORT PIERCE CONDOMINIUM
SECTION II (the "Condominium" ) according to the Declara-
tion of Condominiwn thereof , recorded in Official Records
Book 304 at Pages 1396 through ~08 of the Public
Records of St. Lucie County, Florida as such Declaration
may have been amended by any amendments thereto
hereto filed in the Public Records of St. Lucie County,
Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof ).
Grantee, by acceptance hereof , and by agreement with Grantor hereby
expressly assumes and agrees to be bound by and to comply with all of the
covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including, but not li~nited to, the
obligation to make payment of assessments for the maintenance and operation
of the Condominium which may be levied against the above described Apart-
ment. Grantee expressly acknowledges the existence ~ of a Settlement Stipula-
tion and Aqreement for and Grant of Easements and Other Rights (the "Settle-
ment Stipulation" ) and a Declarat~on of Protective Covenants and Restrictions
(the "Protective Covenants"), as hereinafter set. forth. The Settlement Stipu-
latton provides for this Condomfnium to be served by certain facilities of High
Point of Fort Pierce Condominium Section 1 and the Protecdve Covenants
provides for certain land use covenants upon the land areas described therein
(including, but not li~nited Lo, portions of the land areas included within this
Condominium) and provides for certain drainage easements and other ease-
ments and rights including, but not limited Lo, the "Roadway Easement",
-"Sewage Systean Rights" ,"Water System Rights" and "Future Development'
Property Drainage Easement", all as are more particularly described therein, ~
all in addition Lo the other matters set forth in the Settlement Stipulation and
Protective Covenants, which other matters include, but are not lin~ited to, the
obliqation to pay certain "Assessments" as are respectively set forth in the
Settlement Stipulation and Protective Covenants . Grantee expressly acknowl-
edges and assumes the obllgation Lo pay the amounts assessed ~against the
Apartment under both the Settlement Stipulation and Protective Covenants and
acknowledges that "Assessments" under both the Settlement Stipulation and
Protective Covenants against all properties now or hereafter included within
