This conveyance is made sub ject Lo the following :
1. Real Estate taxes for the year 1961 and subsequent years;
2. Applicable zoninq regulations and ordinances;
3. All of the terms, provisions, uonditions, .rights, privileges,
obligations , easementa and liens set forth and contained in the
Declaration of Condoadnium of the Condaniniwe and all instru-
ment~ referred Lo therein;
4. All covenants, conditions, nstrictions a~d easements of ncord,
if any, which may now affect the aforedescribed property
including, but not timited to, the above•described Settlement
Stipulation and that certain Final Order incorporating same
recorded in Official Records Book 301 at Page 14o i of the
Public Records of St. Lucie County, F~orida and~ above-
described Protective Covenants recorded in Official Records
Book 3oi at Paqe 2965 of the Public Records of St. Lucie
County, Fforida, witt~.~ie Grantor excepting frotn this convey-
ance and reserving unto Grantor and its successors and assigns
as the owner of that portton of the "Future Development Prop-
erty" (as set forth fn the Settlement Stipulation and Protective
Covenants ) not heretofore or hereby oonveyed by Grantor
such easements . and rights as may be necessary tfl effectuate
~ the provisions of the Settlement Stipulatiori and Protective
Covenants including, but not limited to, the drainaqe easanents
"Roadway Easement", "Sewage System Rights", "WaLer System
Rights" and "Future Development Property Draina~e Eaaement"
as set forth in the Protective Covenants, which easements shall
be appurtenant Lo and run with the said "Future Development
Property". ' - .
5. Perpetual easement for encroachments now existinQ or hereafter
existing caused by the settlement or nwvement of improve~ents
or caused by minor inaccuracies in building or rebuildin~ .
To have and Lo hold the same in fee simple forever.
And Grantor does hereby covenant with Grantee that it will defend the
san~ against the lawful claims of all persons claiming by, throuqh or under
Grantor.
