THIS CAUSE having come on before the Court on January 30,
1981, upon the Defendants motion for Rehearing Order for new trial
and the Court having heard the argument of the attorney for the
Defendants, ROBERT J. REID, that an Order should be entered
awarding the damages of September 18, 1980, but not allowing future
benefits and the Court having heard the argument of J. MICHAEL
BRENNAN, attorney for the Plaintiff. and being otherwise fully
advised in this premises, it is
ORDERED AND ADJUDGED that the Plaintiff. ALAN C. ROBERTS, is
entitled to PIP benefits for the loss of wages in the amount of
$3,063.24, together with unpaid medical expenses in the amount of
$57.60, from the Defendants SOUTHEASTERN FIDELITY INSURANCE COMPANY,
and FORT PIERCE TOYOTA, INC., for which let execution issue.
It is further
ORDERED AND ADJUDGED that the Plaintiff, ALAN C. ROBERTS, upon
receiving a check or draft in the amount of $3,I20.84 and accepting
the same by cashing the check or draft shall be entitled to no
future PIP benefits. It is further
ORDERED AND ADJUDGED that this Order does not limit or impair
the rights of thp Plaintiff, ALAN C. ROBERTS, to bring a third
party action or any other cause of action, besides PIP benefits,
against the Defendan~s_, SOUTHEASTERN FIDELITY INSURANCE COMPANY,
and FORT PIERCE TOYOTA; INC.
DONE AND ORDERED this 'Y day of February~ 1981 in Chambers
in Fort Pierce, St. Lucie County, Florida.
