'~'his cause came on to be heard upon Motion for Summary
Judgment filed by the Defendant Oswaldo Benitez, M.D. and
, upon Motion by the Defendant Georae Theodorou, M.D. to strike
the cause from the ~rial calendar.
After oral argument by counsel for the respective parties,
the Court being advised-in the premises, it is
ORDERED AND ADJUDGED that:
1. The Motion for Summary Judgment filed by the Defendant
Oswaldo Benitez, M.D. be and the same is hereby denied.
2. The Motion to strike this cause from the trial docket
on the ground that the same was noticed prior to the complete
case being at issue, filed by the Defendant George Theodorou,
M.D. be and the same is hereby d~nied. Counsel for the Plaintiff
is directed, however, to re-notice this matter for trial so as
to comply with the technicalities of the rules.
The case stands as the first case on this Court's trial
docket for May 4, 1981.
