ORDER
This cause came on to be heard before this Court on the
9th day of February, 1981 upon the Motion for Leave to Amend
filed herein by the Plaintiff. The Defendant also raised his
Motion to Dismiss the punitive damage claim by the Plaintiff
and the Plaintiff stipulated before the Court that the Motion
to Dismiss the punitive damage claim should be granted. Having
considered said Motions, the argument and statement of counsel,
and being otherwise duly advised in the premises. it is thereupon.
ORDERED and ADJUDGED-as follows:
1. The Plaintiff's Motion for Leave to Amend be. and the
same is hereby granted, and the Second Amended Complaint filed
herein by the Plaintiff shall stand as the Plaintiff's Complaint
in this cause, and ~he Defendant shall have ten (10) days from
the date of this Order within which to plead responsively thereto.
2. The Defendant's Motion to Dismiss the punitive damage
claim by the Plaintiff be, and the same is hereby granted, and
all references to or requests for punitive damages filed herein
be, and the same are hereby stricken.
