COMES NOW the Plaintiff, DEPARTMENT OF HEALTH AND RENABILITATIVE
SERVICES OF TFiE STATF. OF FLORIDA, by and through its undersigned attorney,
~1nd moves this Court for an order denyin~ dismissal by the Clerk of Circuit
Court of the above-styled cause and as grounds therefore ~,rould show:
' ` 1. That the above-styled cause is subject to dismissal for lack
of prose~ution on §x}tk~ill~ex~cxi~xx~i~~c February 17, 1981.
2. That the above-n~~med Deiendant has been relocated for service
of process by the Pl:~infiff.
3. That the dismissal of the above-styled cause would cause both
undue expense and waste of time to both the Clerk of Circuit Court and the
Plaintiff.
WHEREFORE, the Plaintiff requests this Court enter an order
denying the dismissal of the above-styled cause.
