PARTIAL RELEASL' OF ~IORTGAGC LIEN
, WHEREAS, HUTCNINSON ISLAND LIMITED, INC., a Delawa~e
corporation authorized to tcnnsact business in the State of Florida, hereinafter
called "Mortgagor," by the following described documents gcanted and conveyed
unto THE FIRST NATIONAL BANK OF CHICAGO, a national banking association,
hereinafter called "1~iortgagee" and its assigns, the premises and property therein
particularly described to secuce the payment of the sum of money hereinafter
mentioned with interest thereon:
1~lortgage given by HUTCHINSON ISLAND LIMITED PARTNERSHIP, as
llortgugor, in favor of THE FIRST NATIONAL BAN{i OF CHICAGO, as hlortgagee,
dated December 4, 1978, and filed in Offieial Record Book 299, at Page 991, in thc
Public Records of St. Lueie County, Florida, in the original amount of Twelve
Million Dollacs ($12,000,000.00), Anc: as modified by Modificution of Mortgage
dated June 2, 1980, and recorded in ~fficial Records Dook 332 at Page 1738 of the
Public Rec~rds af St. Lucie Count~, Florida, wherein HUTCHINSON ISLAND
LIMITED, INC. assumed the indebtedness secured by said :Nortg~oe, and inereased
the indebtedness to the principal sum of Thirteen Aiillion DoUa~s (~13,000,000.00),
together with an Assignment of Leases, Rents ar.d Profits recorded in Official
Reeord Qook 299, at Paoe 1002, und UGC-1 Finanein~ Statement recorded in
Official Itecord Book 299, at Pagc 1008, ~li of said docume~its filed in the Public
Records of St. Lucie County, Plorida, ~nd in addition, fi UCC-1 Financing
Statement filed with the Secretary of State, State of Floridt~, ~n December ?,
1978, under rile No. 966909, between s~iid p~rties; and
NHEREAS, the said ~Iortgage has requested the snid i~lortgF~gee to
release the premises and other property hereinufter described, bcing a part of said
1lortgage; and encumbered premises, from the liens and operation of said Mortgage
and other liens; v~
NOW, 'CHEREFORE, KNOW YE, that the said Mortgagee, in considera-
tion of the premises and the sum of Ten Dollars ($10.00) and other good and
valuable considerations to it in hand paid by or on behalf of the said mortgagor at
the time of the execution hereof, the receipt whereof is hereby acknowledged, does
remise, release, quit-claim, exonerate, and discharge from the lien and operation
of said -iNortgage and other liens referred to above unto the said Mortg~gor, its
successors and assigns that certain portion of tF~ premises conveyed by said
1~tortgage, and other liens referred to above more particularly described as follows:
Condominium Parcel No. 4271 , SEASCAPE I
CLUSTER - PHASE (B), a Condominium, according
to the Declaration of Condominium recorded
September 11, 1980, in Official Records Book 338,
at Page 1033, of the Public Records of St. Lucie
County, Florida, and any amendments thereto.
TO ~iAVE AND TO HOLD the same, with the appurtenances, unto the
said 1lortgagor, its successors and assigns forever, freed, exonerated and
discharged of and from the lien of ~id ~tortgage and every part thereof; p~ovided
always, nevertheless that nothing hcr~in contuined shall in anywise impair, aiter or
diminish the effect, lien or encumbr~nce of the aforestiid 1~lortgage and other liens
referred to above on the remaining property of said ~nortg~ged premises, not
hereby released therefrom, o: any of the rights and remedies of :he holder tliereof.
