AMENDMENT OF DECLARATION OF
RESTRICTIONS AFFECTING PORT ST. LUCIE
SECTION FORTY
WHEREAS GENERAL DEVELOPMENT CORPORATION, a Delaware corporation
authorized to do business in the State of Florida, hereinafter referred
"General", caused a Plat of General's land in St. Lucie County to be re-
corded as Port St. Lucie Section Forty in Plat Book 15 at Page 34 of
the Public Records of St. Lucie County, Florida;and

WHEREAS a Declaration of Restrictions dated July 31, 1970 affect-
ing said Plat, hereinafter referred to as "Declaration", was filed by
General in Official Records Book 186 at Pages 873 through 877 of the
Public Records of St. Lucie County, Florida; and
WHEREAS Paragraph #27 of the Declaration p~ovides that the re-

strictions may be altered, amended or rescinded in whole or in part at
any time by the then fee owner or fee owners appearing of record of a
majority of the Lots affected by the respective provisions of these re-
strictions; and
WHEREAS General is the fee owner of record of a majority of
all of the Lots affected by the Declaration, and in such capacity de-
sires to amend and rescir.d certain prov}sions of the Declaration with
respect to all Lots in said Plat.
NOW THEREFORE, General, as the fee owner of a majority of all
Lots in said Plat, does hereby declare that Section numbered 2 of said
Declaration of Restrictions entitled "Building Setback Requirements" be
and the same hereby is amencied to provide as follows: . '

,(2) Building Setback Requi,rements-"Building Setback Requirements
for structures on single family residence Lots shall be'in accordance
with the requirements of the City of Port St. Lucie and/or the County of
Port St. Lucie Zoning Regulations as the same now exist, may be amended,
and/or superseded from time to time."
In all other respects, the terms, covenants and conditions
of that certain Declaration of Restrictions affecting Port St. Lucie
Section Forty, according to the Plat thereof, recorded in Plat Book 15
