PETITION FOR LEAVE TO SELL The petitioner, Muriel Concannon, respectfully shows: 1. Gerald J. Concannon died intestate on September 29~ 1980 and petitioner was appointed personal representative of his estate on January 12, 1981 with the written consent of all of de- cedent's heirs at law being filed with the court. Petitioner deems it for the best interest of the estate that the following property of the estate be sold: Lot 3, Block 505, Section 10, PORT ST. LUCIE, according to the plat thereof as recorded in Plat Book 12, page 49, 49-A through 49-G, of the public records of St. Lucie County, Florida. 2. The house situate on the above described property was partially completed at the time of decedent's death. Decedent purchased the lot, designed, financed and built the house solely for speculation and im~-ediate sale in the course of decedent's business. With the house partially completed and upon decedent's death, the financing institutio*~ agreed to extend the time for completion to give the personal representative of the estate an opportunity to complete the house and obtain a purchaser therefor. 3. The house is substantially completed at this time and a bonafide contract for sale and purchase has been entered into between the personal representative, as seller, and Barbara Moran~ as purchaser, for the total purchase price of $41,900.00, with the purchaser to assume the first mortgage of approximately $28,400.00 and pay the balance between the first mortgage and selling price in cash. A copy of the contract is attached hereto and made a part hereof.
