HomeMy WebLinkAbout2858prior to e~try of a judgment enforcing lhis Mortgage if: (a) Borrowe~ pays Lcndcr all sums which would be theii due u~der this 111ortgage, the Note and notes securing Future Advance~, if any, had no acceleralion occurred; Ib) Borrower cures all breaches of any other covenants or agreements of Borruwe~ r~~ntained in this Mortgage; (c) Borrower pays all reasonable expeous incurred by Lender in enforcing the covenants and agreements of Borrower co~tained in this Mortgage and in entorcing Lender's remedies as provided io paragraph 18 hereof, including, bul not limited to, reasu~able attorney's fees; and (d) Bor~owe~ takes such action as l.ender may reasonably reyuirc to assure that the lien of this Mortgage. l.ender's interest in Ihe Prooeny and Borrower's obligation to pay 1he sums secured by this Mortgage shall continue unimpaircd. Upon such payment and cure by Borrower, this Martgage and ~he obligations secured hereby shall remain in full torce and eBect as it no acceleration had occurred. 20. A~oment ot Rents; AppoiMmenl ot Recei~•e~. As additional security hercunder, Borruveer hereby ascigns to Lender the rents ot the Property, pro~•ided that Borrower shall, prior to acceleration under paragraph 18 hercof or abandon- mrnt~of the Property, have the right to collect and retain such rents as they become Jue and payable. Upon acceleration under paragraph 18 hereof or aha~donment of the Property, Lender shall be entitled ta have a receiver appoi~ted by a court to ente~ upon, take possessia~ of and manage the Property and to colltct the rents of the Property, including those past due. All rents collected by the receiver shall be applied first to payment of the costs of management of the Property and collection of rents, including, but not limited to, receiver's [ees, premiums on receiver's twnds and reasonable attorney's fces, and then to the sums secured hy this Mar~gage. 71~e receiver shall t~e liable to account only tor those rents actually received. 21. Furore Adva~icea. Upon rcyuest by Hbrrower, l.ender, at Lendcr s option within twenty years from the date of this Mortgage. may make Future Advances to Borrower. Such Future Advances, with interat thereon, shall be secured by this Mortgage when evidenced by promissory notes stating that said notes are secured hereby. Rclease. Upon payment of all sums secured by this Mortgage, Lender shall release this Mortgage without charge to Borrower. Borrower shall pay all costs of recordation, if any. 23. Attoraey's Fees.
