defalcation, to the order of OSCAR T. ~ MAIN and t4ILDRF.n. L, t4AIN, at

sum o~ ONE HUND'RET~ EIGHT THOUSEIND EIGNT HUN~RED AND NO/100 DOLLARS
with interest from February~21, 1981, at the rate of 13% per annum,
in monthly installments as follows: $108,800,00 payable over twenty
(20) years in equal monthly payments includin~ inCerest at 13°~ per
annum from February 21, 1981, ($1,274.69); the first payment to be
due and payable on March 21, 1981, and monthly thereafter for a
period of ten (10) years at which point the principal and accrued
interest remaining unpaid shall be amortized over ten (10) years in
equal monthly installments including interest at 14% per annum, the
first of such monthly installments to commence 121 months from
February 21, 1981. ~
Each installment first shall be applied in payment of the interest
and then on the unpaid balance of the principal sum. ~~ default is
made in the payment of any installment when due, and said default
remains uncured for a period of thirty (30) days, then at the option
of the holder, and without any other notice, all of the remaining
installments shall be due and payable at once. In the event any
monthly installment is not paid within fifteen (15) days of its due
date, a late charge of S% of the amount of such installment shall he
payable in addition to the installment due hereunder. In the event
of prepayment in whole'or in part, the mortgagee shall have the
right to assess a prepayment penalty of 3% of the unpaid urincinal
balance, nroviding said prepayment occurs within three (3) years of
the date of this tlote. Otherwise, privilege is given ro pay two (2)
or more installments at any installment maturity date and any .,__,~ ~~
partial prepayment shall not extend the time of maCurity of any such ~
an installrient. Neither forbearance, nor acceptance by the holder
hereof after any default in any payment hereon, shall be deemed .
extension. ~
Each maker, surety and endorser hereof, jointly and severally waives
demand, presentment, protest and notice of protest ~or non-nayment,
and further agrees to any extension of time of payment, either
before or after maturity, without notice to any of us; and to pay
all costs of collection, including a reasonable attorney's fee in
the event of any default hereunder, and hereby severally waives all
benefit of homestead and exemption under the constitution and laws
of each State of the United StaCes, as a~ainst this obligation or
any extension or renewal hereof. .~
