PARTIAL RELEASE PROVISION (Continued):
3. At the time of request for partial release, Mortgagor
at its expense shall furnish Mortgaqee survey data delineating
a*:~ describing the parcel to be released and certifying its acreage.
Documents•of~partial release shall be prepared and recorded at the
expense of Mortgagor. ~
_ EXCULPATORY CLAUSE
Mortgagee, for itself, and its successors or assigns, by the
acceptance and recording of this mortgage, covenants and agrees to
and with Mortgagor that in the event of Mortqagor's default hereunder or
default in payment of the promissory note which is secured hereby,
Mortgagee may proceed solely against the lands encumbered hereby,
_ and Mortgagee hereby covenants that no deficiency decree shall be
sought against Mortgagor or against any other person or entity
in the event of such default by Mortgagor.
SUBORDINATION CLAUSE
Mortgagee, for itself, its successors or assigns, covenants
and agrees that so long as no default exists hereunder, or under
the promissory note secured hereby, that Mortgagee shall subordinate
the lien and operation of this mortgage to necessary easements for
utilities, drainage and roadways, including, without limitation,
gas, telephone, electrical lines and conduits, sewer and water lines,
and lift and pumping stations to serve the lands of Mortgagor
unencumbered hereby,so long as such subordination is reasonably
required in connection with the development, use and enjoyment
of the unencumbered property of Mortgagor as demonstrated by the
Developement plans and specification of Mortgagor delivered to
Mortgagee.
