Any ~ amounts so advanced shall bear interest at the then current rate I prescribed in the Note. ~ 8. Borrower and the Other Weston Entities shall, upon ~ request of Bank, furnish it a complete list of all Contracts, ~ Licenses and Sales Ar~reements. Further, if requested, Borrower I and the Other tr'eston Entities shall deliver to Bank executed or certi~ied copies of all Contracts, Licenses, Sales Agreements, and ~ther written agreements, correspondence and memoranda betwe^n Borrower or the nther Weston Entities (and its predecessors in title) and Contractors, Governmental Authorities and Purchasers, , setting forth the contractual and other arranqe!nents between them. ~ To tne extent that Borrower and the Other Westvn Entities do not have executed or certified copies of the fareqoing in its possession, Borrower and the Other Weston Entities shall deliver ' copies of those of the foregoing which are in their possession, with~a certification that to the best of F3orrower's and the Other Weston Entities' icnowledge and belief, they are true and correct conies. . ~ 9. yothing herein contained shall be construed as rnaking I ` Rank a_mortyagee in pc~ssession, or as constitutinq a waiver or E suspension by Bank ~f its right to enforce payment of the debts ~ under the terms of the Note, M~rtgage, Loan Agreement, or other ~ s : ~ Loan ~ocuments. This Assignment may be enforced from time to time by Rank ~ ~ s ~ ' at its discretion, with or without order of any court and with or witho~t appointment of a receiver, as F3ank shall determine.
