In latc Dccc~nher. oi 1975 or January of 1976, Tor~my
sold thc~ t;rocery store. Tommy, Emma Lou and Jean moved to
Fort Pierce, Florida. The jewelry store venture apparently
failed at some time after that. Emma Lou, in failing health,
returned to Y~en~ucky in ~ebruary of 1978. It should be
noted that the relationship between Emma Lou and Jean through-
out their <~cquaintance was sometimes strained.
In Floricta, Tc~mmy's eondition began to deteriorate. ~
He experienced l:idney problems and, in September of Z977,
began dialysis. Tommy experienced severe cramping in his
legs as a result of dialysis. -
Tommy met Chester Griffin, the Florida attorney
who prepared his will, in the fall of 1976. At that time,
! Tommy discussed the possibility of setting up a corporation. ~

Later Z'oruny asked Griffit~ to prepare his.wiil. Two wills • ~
~ wcre acturilly }~repared; on~, dated April, 1978, and the one ~
~ contested iiere dated J~-~nuary 9, 1979. i
~ On December 26, 1978, Emma Lou died. Tommy came
~ to Kentucky £or the funeral. tiis condition had deteriorated

~ to the point where he had to be assisted in sitting and
