proportion to the cost of reconetruction and repair of their
respective properties. Such assesements oc~ account of damage
to commo~ elements shall be in proportion to the owner's share
in the common elements.
8.9 Deductible Provisione. The funda necessary to
cover any deduct e amount un er an inaurance policy againat
which a claim is made shall be a common expense.
. 9. ~fINENT DOMAIN. The taking of a portion of a unit or
of the common e ements y eminent domain shall be deemed to be
a casualty, and the awards for auch taking shall be deemed to
be proceeds from insurance on account of the casualty, and
shall be depo8lted with the InBUrance Truetee. ~en though the ~
awards may be payable to the unit owners, the unit oWaers shall
deposit the awards ~i.th the Insurance Truetee; and, i~ the
event of failure to do ao, in the discretion of the Board of
Directors of the Association, a apecial assessment shall be ~
made againet a defaulting unit owner in the amount of his '
award, or the amount of such award shall be set off against the
sums hereafter made payable to euch oWner. The proceeds of the
awards shall be distributed or used in the manner heretofore
provided for insurance proceeds.
10. USE RESTRICTIONS. The use of the property of the
condominium s 8 e n accordance With the following
provisions:
10.1 Units. Each of the units shall be used only
for the cultivat

No unit may be divided or subdivided into a smaller unit nor
any portion thereof otherwise altered without.first amending
this Declaration to show the changes in the units to be
affected thereby.
10.2 Common Elemente. The common elements shall be
used only for the purposes or which they are intended in the
furnishing of services and facilities for the servicing,
maintenance and operation of the units.
11. TRANSFERS SUBJECT TO APPROVAI..
~ a. Sale.~ No unit owner may dispose of a unit
or any interest t~Fierein by sale to any person other than
another unit owner without approval of all unit owners of
record.
b. Lease. No unit-owner may dispose of a unit
or any interest tTierein by lease without approval of.all
unit owners of record.
c. Gift. If any unit owner shall acquire his
title by gift, tT-ie continuance of his ownership of his
unit shall be subject to the approval of all unit owners
of record.
d. Mort a e. No unit owner may mortgage a unit >

e. Devise or-Inheritance. If any unit owner `
acquires his t t e y any manner not heretofore considered
in the foregoing subsections, the continuance of his '
