The upper and lower boundaries of the UNIT ahall be the_following boundaries extended to an intersection with the perimetrical boundariess (1) UPPBR BOUNDARY--The plane of the unfinished, interior surface of the ceiling above each UNIT excluding the slab or ceiling over a balcony, patio or terrace which serves only the UNIT being bounded and which balcolny, patio ar terrace is designated on Bxhibit A as a LIMITSD COMMON ELEMBNT. (2) LOWBR BOUNDARY--The plane of the undecorated and/or unfinished floor excluding the slab of a balcony, patio or terrace which serves only the UNIT being bouRaea, and which balcony, patio or terrace is designated on Bxhibit A as a LIMITSD COMMON ELBMBNT. 4.2.2 PERIMETRICAL BOUNDARIES: The perimetrical boundaries of a UNIT shall be the following boundaries extended to .intersections with each other and with the upper and lower . . boundaries: . a. EXTERiOR WALLS: (1) Where this is an exterior wall (which is a wall located on the perimeter of a UNIT which is not a common, party wall with any other UNIT), the vertical plane of the undecorated, unfinished, interior surface of such wall; (2) Where there is an aperture for windows and doors, in any perimetrical boundary, said boundary shal~l be extended to all such places, at right angles, to the dimension of such aperture, so that the permimetrical boundary at such places shall be coincident with the exterior, undecorated, unfinished surface of such aperture, including the framework thereto; (3) Exterior ~alls made of glass or glass fixed to metal framing, exterior windows and metal frames, exterior glass sliding doors, metal frames, metal casings and screening . shall be included within the UNIT and shall not be deemed a COMMON ELEMLNT. b. CO~lMON PARTY WALLS: Where there is a common ~ party wall (which is a wall common to two UNITS located on the ~ perimeter of both UNITS) the vertical plane of the undecorated, unfinished, interior surface of such wall. ~ c. INTERIOR PARTITIONS: The interior partitions ~ _ within a UNIT are part of said UNIT. ~ 4.2.3 WEIGHT BEARING STRUCTURES. Each UNIT shall not include the area beneath the unfinished surface of any weight ~ ~ bearing structure which is otherwise within the horizontal and perimetrical boundaries. 4.2.4 hlAINTENANCE EASEMENT. In addition to the space within the horizontal and perimetrical boundaries, there shall be ~ ~ within each UNIT, as a COMMON ELEMENT, an easement through said UNIT for the purpose of providing maintenance, repai~c or services ~ to the ducts, pipes, conduits, plumbing, wiring or other ~ facilities for the furnishing of utilities to~the UNITS and the COMMON ELEMENTS. ` ~ ~ ~ 4.2.5 UTILITIES. All water and sewer lines outside ~ UNIT boundaries constitute COMMON ELEMENTS up to shut-off valves ~ for particular UNITS. All water and sewer lines within the F boundaries of UNIT, but which serve more than one UNIT, are ° COMMON ELEMENTS. All water and sewer lines.within or without the - # boundaries of a UNIT, which serve only one particular UNIT,-are ~ part of the UNIT served down to the shut-off valves for the UNIT. ~ Electrical wiring ar~d conduits outside UNIT boundaries constitute ~ COMMON ELEMENTS up to distribution panels for particular UNITS. ~ Electrical wiring and conduits within the boundaries of a UNIT, ~ ~ but which serve more than one UNIT, are COMMON ELEMENTS. ~ ~ 4 aoox Pac~ ~98 ~ ~ ~ GARY. pYTRYCH A RYAN.
