Clectrical wiring and conduits within or without the boundaries of
a UNIT, which serve o~ly one particular UNIT, are part of the UNIT
served down to the distribution panels for the UNIT. All other
pipes, wires, eonduits and other utilfty lines, regardless of
location, constitute part of the COMMON BLSNENTS up to their
outlets. ~
4.2.6 AIR CONDITIONING. Notwithstanding any of the
provisions of this Paragraph 4 to the contrary, the air
conditioning compressora located on or near any building and the
refrigerant and electrical lines running from such compressors to,
and the air handler within, the individual UNITS shall be deemed
owned by the UNIT OWNERS and are not a part of the CO[rlMON
ELEMENTS. ~
4.2.7 EASEMENT FOR AIR SPACE. There shall pass with
each UNIT, as appurtenant thereto, an exclusive easement for the
use of the air space occupied by the UNIT as it exists at any
particular time and as the UNIT may be altered or reconstructed
from time to time, which easement shall be terminated
automatically~in any air space which is vacated from time to
time.
4.3 LIMITED COMMaN ELEMENTS. The shaded areas on EXHIBIT A
which are designated "Limited Common Element" are declared to be
LIMITED COMMON ELEMENTS appurtenant to the UNIT which is served by
said area so designated. The only LIMITED COMMON ELEMENTS consist
of the balcony, patio or terrace which serve only the UNIT being
bounded. The upper boundary of the LIMITED COMMON SLEMENTS is
the plane of the undecorated interior surface of the ceiling or
slab above the balcony, patio or terrace; the lower boundary of
the LIMITED COM[~ON ELEMENTS shall be the plane of the undecorated,
unfinished floor or slab. The perimetical boundaries of the
LIMITED COMMON ELEMENTS shall vary with the exterior, undecorated,
~ unfinished surf ace of any such structure extended in a vertical
plane, where necessary, to the upper and lower boundaries, except
that when there is a common party wall between balconies, patios
or terraces then the boundary shall be the center plane of such
wall. The LIMITED COMMON ELEMENTS shall include any screening,
railings or carpets located on such balconies, terraces or patios
~ and shall not include the wall between the UNIT bounded and the
LIMITED COMMON ELEMENT or any part of the ceiling or roof or slab
~ or floor located above or below the LIMITED COMMON ELEMENTS.

~ a. The use of the LIMITED COMMON ELEMENTS appurtenant ~
~ to a UNIT is restricted to khe OWNBR of such UNIT and sucYi OWNER'S
' family, guests and invitees. Maintenance and upkeeF of said area
~ shall be the responsibility of the OWNER of the UNIT to which the
LIMITED COMMON ELEMENT is appurtenant, at said OWNER'S cost and
expense. ~

b. No UNIT OWNER shall make or permit any alteration or
improvements to the LIMITED COMMON ELEMENT areas without prior
written approval of the ASSOCIATION and SPONSOR. Any increased
cost of maintenance, as determined solely by the ASSOCIATION,
~ resulting from any alteration or improvements to the LIMITED
~ COMMON ELEMENTS shall be borne by the OWNER and the A5SOCIATION
shall have the right to levy an assessment against the OWNER for
~ such, which shall have the same force and effect as an assessment
~ for COMMON EXPENSE.
