2. Perfornanoe of obli ations. M~rtrgagor will pay the princfpal of the Not,e, and the ~
interest thereon, as when the sane shall becane due and payable, and sha12 duly pay,
perform, arid discharge all of its ott~er obligatfons created hereunder ~ secured hereby.
3. ~Le
al~~Aec ireiaents. Mortgagor shall gra~tly and faithfully amply with, conform
to, and obey a~l present future laws, o~~dinanoes, rules, regulations, and requirements
of every duly oonstituted go~errmental authority or agent and every Board of Fire Under-
writers havirg jurisdiction, o~r similar body exercising similar functions, which may be
applicable to the [?brtgaged Premiseg, or any part thereof, or the use or manr~er of use, ~
occupancy, possession, operatfon, maint,enanoe, alberation, repair or reconstruction of the
Mortgaged Premises, or any part thereof, whether or not such law, ordinance, rule, order, ~
regulation ar requirement shall neoessitate structural changes or in~ro~remerits or interfere r
with the use and enjoyment of the lN~rbgaged Premises. F
4. Impo.sitions.
4.1 Taxes. Mortgagor sha:l pay and discharge, or cause 'to be paid and dis-
charged, on or before the 30th day of I~bv~d.~er of each year or not later than thirty ( 30 )
days aft~er the same shall be due and payable, whichever date is first, all taxes, asses-
sments, f+ees and other go~errn~ental charges (and any interest or oosts with respect thereto)
and all charges for any ease~nent or agreement maintained for the kienefit of the Mortgaged
Premises, general and special, ordinary and extra-ordinary, foreseen and unforeseen, of any
kind and nature whatsoever, that at any time prior to or after the execution of this
Morbgage may be asses.9ed, levied, or imposed upon the Mortgaged Premises or the rent or
inoane receiv~ed therefram or any use or occupancy thereof (hereinaft~er the "Impositions").
Mortgagor shall furnish reoeipted bills to Mortgagee upon receipt by Mortgagor fran the
appropriate taxing or other authority, or other evidence reasonably satisfactory to
Mortgagee, evidencing the payment of all Impositions. If any tax or assessment levied or
asses.9ed against the lrbrbyaged Premi~es may legally be paid in installments, hbrbgagor shall
have the option to pay such tax or assessments in installments. Notwithstanding the fore- '
going, Morbgagor may, at its own expense, aft~er prior writt~en rotioe to Mortgagee, oontest
by a~propriat~e prooeedirgs, pramptly initiated and conducted in good faith and with due
diligenoe, the anount, validity or application, in whole ar in part, of any Imposition if:
(a) such prooeedings shall suspend the oollection thereof fran t~brt,gagor and
frun the Mbrtgaged Premises; and,
' (b) Mort~gagor shall have furnished such security and in such form as may be
I required in the prooeedirgs or as may be reasonably requested by irbrtgagee.
~ 4 2 Doc~mentary and Other Sta~ Taxes. If at any tiine the United States, the
state in which the Mortgar~ed Premises is located ar any p~litical subdivision thereof, or
i any department or bureau of any of the foregoing shall require docunentary, rev~enue ar other
~ stamps on the Not~e or this hbrtgage, ar any intangfble or other taxes thereon, Nbrtgagor on
demand from Nbrtgagee shall pay for sane with any interest or penalties thereon.
4.3 Changes in Law Regardirg Taxation._ If any law ar ardinanoe hereaft~er imposes
a tax directly ar indirectly on Nbrtgagee with respect to the Mbrtgaged P~~nises, the value ~
of Mbrtgagor's equity therein, ar the indebt~edness evidenoed by the Not~e and secured by this ~
Mortgage, Nbrt~gagor shall p~ra~tly pay such tax. If M~rtigagvr fails to pay such tax or if
Mortgagar is rot lswfully pernnitted to pay such tax, lrbrtgx,~ee, at its election, shall have
the right at any time to giv~e Mbrtgagor written r~tice declarir~g that the principal debt,
with interest and other appropriate changes, shall be due on a specified dat~e not less than
sixty (60) days thereafter; pravided, hawev~er, that such election shall be ineffective if,
prior t~o th~e specified date, Mortgagor lawfully pays the tax (in addition to all other
payments r~equired hereunder) and agrees t~o pay the tax whenever it becomes due and payable
thereafter, which agt~ee?oent shall then oonstitut,e a part of this hbrtgage.
5. Insuranoe. Nbrtgagor shall maintain insuranoe ~n th~e Mbrtgaged Premises against N

~ such risks as may be specified by Mortgagee from time to time.and in amounts. and with !
insurers ~cveptable to M~rtgagee. Each insurance policy shall provide, and the insurer
~ issuirg such a policy shall oertify t~o Nbrtgagee that:
(a) loss payments will be payable t~o l~brt~gagee as its interest may appear (such
payments t~o be applied tA the restoration, repair ar replaoe~nent of the property damaged or
destroyed, or at the option of M~rtgagee, to the payment of the principal and interest on
the Note and any oth~er indebtedness secured hereby):
