21. Subse nt Owr~ers. In th~e ev~ent the a~rtiership of the Mortgaged Premises or any
part thereo eoomes ves in a person other than hbrtgagor, the i~brtgagee may without
notioe Go Irbrtgagor, deal with such sucaesaor or sucoes~ors in interest with reference to
this l~brbgage and t,o the Note secured hereby in the same manner as with iYbrtgagor without in
any way dischargirg or vitiatiryg Nbrtigagor's li~+bility hereunder or upon the Note or any
loan agree+oent between Nbrbgagor and Nbrbgagee.

22. Partial Payment. A~eptanoe by the Nbrtgagee of any payment in an amount less
than the amount thsn due_ on the Note or due hereunder shall be deemed an acceptance on ;
acoount only, and ttye failure to pay the entire anount then due shall be and oontinue to be
an ~ent of Default. At any time thereafter, until the entire amount then due has been ,
paid, the Morbgagee shall t~e entitled tro exercise all rights vonferred upon it in this Mort '
gage upon the occurrenoe of an Ev~ent of Default.
23. ~rther Assuranoes. irbrtgagor agrees that at any time, and fram time to time,
aft~er execution del v~ery of this Morbgage it will, upon the request of Nbrt~gagee, and at
Mortigagor's sole expense, execut~e and deliv~er such further doc~anents and cb such further .
acts and things as Mc~rt~gagee may reasonably request in orrler t,o fully effect the pu~po~es of
this Nbrbgage and t~o s~bject to the lien of this Mortgage any property intended by the
provisions~ hereof tA be oo~rered he~+eby. ~
24. Estoppel Qertificate. Mortgagor shall, within fiv~e (5) days from written demand
by the I~brtgagee, execute in svch foYm as shall be required by the Mortgagee, an Estoppel
Certificate and Waiv~er of Defenses duly acknawledc~ed setti.rg forth the amount of principal
and interest unpaid hereunder and the general status of this' Mortgage. Failure of the
Mort~gagor t~o make and deliver to [!brbgagee the Est~pel dertificat~e and Waiver of Defenses
within the required time shall oonstitut~e an ~rent of Default hereunder. ~
25. FLture Advanoes. This Mortgage is giv~en not only to secure payment of the t~bte
( whether the entire amunt shall hav~e been advanoed tA ar for the bene f i t of . the Mortg agor
at the date hereof, ar at a lat~er dat~e); but, also t~o secure any other amount or anounts,
together~with inGerest thereon, that may be advanoed at any time, but not more than tw~enty
( 20 ) years aft~er the dat~e hereof, urxjer the t~ern?s of this Mortgage. Tfie total amount of
i ndebtedness secured hereby may decrease or increase fran time t~o time but the t,otal unpaid
balance so secured at any one time shall not exceed the principal sum of TWO H[JNORED
Zw~IT7f-TWiO D~lOUSAND AND NO/100 DOLtARS (5222,000.00) plus interest thereon, plus such other
disbursements as may be made by Mortgagee pursuant to the terms of this Mortgage, with
interest thereon. Nothirg herein oontained shall be dee~ned an obligation on the part of rhe

' 26. Security Agr~eetrent. 1b the extent that the Irbrt~gaged Premises shall be deemed to ~
~ t~e personal property, this M~rtigage shall serve as a"security agreement" within the meanirg `
~ of the Uniform Cam~ercial Code as adopted in the state where the Mortgaged Premises is ~
R situat~e. Mortgagor hereby grants bo Mbrdgagee a secwcity interest in and to all of those
portions of the Mortgaged Premises which may ultimately be held to be_personal property. ~

27. P~ees and Costs. Mortgag~r shall pay all the oosts, charges and expenses, includ- I
~ ir~g attorneys' fees, reasonably incurred or paid at any time by the Mortgagee, because of ~
the failure~of the Mortgagor t~o perform, oanply with and abide by each and every one of the ~
stipulations, agree+nents, oonditions and oon~enants of the t~bte ar~d this hbrtgage, ar either. '
~ All such payments shall be secured by this Nbrt~gage and shall bear interest at the default
t int~erest rat~e p~avided herein. ~
28. Default Interest. Upon the occurrence of an ~ent of Default, the principal
amount of tl~e I~bt,e, t~ogether with all aocrued but unpaid interest, and together with all
suns which may have been advar~d by Nbrtgagee and which are secured hereby, shall bear
interest at the rate of five peroent (5$) ~o~re the Applicable Interest Rate set forth in
the Note, per year, ~mtil paid. ~
