5. As of.the date of this Certificate,•the under-
signed, as Landlord, is not in default in the performance of ~
the terms and conditions of the Lease and has not committed
any breach of the Lease.
6. No rent has been paid by Tenant in advance under
the Lease except for and the minimum
monthly rent that became due on 7' 198 ~.3
7. Tenant has no claim against the Landlord for any
security deposit or prepaid rent except as provided in Item
~6 of this Estoppel Certificate. ~
8. That ~there are no actions, whether volunta~y or
otherwise, pending against the undersigned under the
Bankruptcy Laws of the United States or any state hereof.
! 9. This certification is made by the undersigned to
! induce Denny's, Inc. to accept an Assignment of the
~ above-referenced Lease from the current Tenant, Sambo's
Restaurants, Inc., knowing that Denny's, Inc."relies upon
~ the truth of this Certificate in agreeing to assume the
~ provisions and obligations of said Lease. i
