TERM: The term of this Lease shall be for 25 years. The estimated commencement date is January 1, 1974 . The actual commencement date will be (a) the date of openinq of the_ restaurant for business by Lessee, or (b) a date 30 days after completion of the improvements ~o~be constructed by Lessor, which- ever is earlier. ~ In the event saiv commencement date falls on other than the first day of a month, then Lessee shall pay a prorated rent for said partial month and the 25-year term of the Lease shall be adjusted to run fro~: the first day of the following month. A written memorandum of the adjusted commencement date shall be executed by both parties and attached to this Lease, as soon as same is ascertained. 4. RENT: ~ A. Minimum Rent: Lessee agrees to pay a minimum monthly rental in the sum of $ 2,225.00 per month. The minimum I~ ~ ! ~ ~ and the additional rent for each month shall be paid at the same ~ ~ time, on or before the 15th day of .the following month. - ~ A written memorandum of the a4justed minimum rent shall be executed by both parties and attached to this Lease, as soon as same is ascertained. The deposit provided for in para- graph 5 hereof ~shall be adjusted at the same time. B. Percentage Rent: Lessee aqrees to pay to Lessor, as ndditional rent in each year durinq the term of this ~ Lease, a sum equal to 6$ of Lessee's qross sales in and from said ~ remises in such ear, co uted as hereinafter provided, less the ~ P Y mP ~ ~ aggreqate a$iount of the minimum monthly rental. ~ C.
