Consent is qiven in aZvance to an assi ~i,ment to a joint venture cr other entity formed to operate the restau- rant an the Ieased premises which :s at least 50~ owned or controlled by Sambo's Restaurants, Inc., without, ho~wever, in any way releasing Sambo's Restaurants, Inc., from full responsibility. 9. INSOLVENCY: If any proceedings in bankruptcy or insolvency be filed against Lessee or if any writ of attachnent or writ of execution be levied upon~the interest herein of Lessee and such proceedings or levy shall :.ot be released or dismissed within 60 days thereafter, or i~ any sale of the lease- hold interest hereby created or any part thereof should be made under any assignment for benefit of creditors, or shall volun- - tarily institute bankruptcy or insolvency proceedings, Lessor, at its election, may re-enter and take possession of said prer.?ises anu remove all persons therefrom and may at its option terminate this Lease. ~ 10. ATTORN£Y'S FEES: In the event of any litigation between the parties hereto arising out of this Lease, or the leased premises, the prevailing party therein shall be allowed aIl ~ reasonable attorney's fees expended or ir.curred in such litigation to be recovered as a part of the costs therein. ~ 11.
