shall be subordinate to ~ny mortqages or trust deeds that may
hereafter be placed upon the premises, to any a~nd all adva~nces
made or to be made under them, to the interest and all obligations
secured by them, and to all renewals, replacer.tents and extensions
of them. Provided, however, the mortqagee or beneficiary named
in any such mortqages or trust deeds shall recognize the lease of ~
I.essee in the event of foreclosure if Lessee is not in default
under the terms of this Lease. If any mortgagee or benefici~ry
elects to have this Lease superior in its mortqage or deed of

trust and qives notice of its election to Lessee, then this Lease
shall be superior to the lien of any mortgage or trust deed whether
this Lease is dated or recorded before or after the mortqage or
- trust deed.
_ 26. RELATIOi~SHIP OF PARTIES: It is understood and
agreed that the relationship of the parties hereto is strictly
that of landlord and tenant and that Lessor has no ownership in -
Lessee's enterprise and that this Lease shall not be construed as
a joint venture or partnership. Lessee is not and shall not be
deemed to b~ an agent or representative cf Lessor.
27. EXCLUSIVE: If Lesst~r is or becomes the owner or in
control of other real property contiguous to or within view of
the leased premises, then Lessor shall not permit said property ~
to be used for family restaurant purposes without the prior ~
written consent of Lessee herein. ;

; 26. WARRAN~'X: Lessor warrants that the leased prem- !

ises are properly zoned to permit the restaurant use contemplated
~ herein, includinq 24-hour operation, and that all utility services
norn~.ally required far such use are available to the leased premises,
