("Assignee"), a California corporation. WITNESSETN WHEREAS, Alexander Leo Johnson and Mary Ellen Johnson ("Lessor") entered into a Lease Agreement with Assignor's predecessor in interest, Sambo's of Greater Miami, Inc., dated February 11, 1977 (the "Lease") for property fully described in the Lease, a copy of which is•attached hereto, ~ located in the City of Fort Pierce, in the County of St. ~ 3 Lucie, State of Florida; and _ i WHEREAS, the Commencement Date of the Lease was February 11, 1977, and the Expiration Date of the original term is May 31, 1999, plus one additional option term of five years; and WHEREAS, Assignor-desires tp assign and Assigne~ desires to assume all of Assignor's rights, title and interest, duties and liabilities unde~ the Lease in all of the property the subject of the Lease; + NOW, THF.REFORE, in consideration of the sum of ten . ($10.00) dollars and other good and valuable consideration, receipt of which is hereby acknowledged by the Assignor, Assign~r assigns (i) the Lease to Assignee effective the ~394 P~ 949 ~
