Real Estate Settlement Procedures Act of 1974, as amended and Regulat.ion "X" of the
Secretary of Housing ar~d Urban Developnent ber.ause the p~roceeds of the loan are not being
used in v~hole ar in part tA finance the purchase by the Nbrtgagor or other transfer of legal
title of the Mortgaged Premises.
(9) Non-Hanestead Pro~~erty. Nbrtgagor hereby represents, oertifies, and warrants
that neither the Mortgaged Pre~uses ror any real p~roperty o~ntiguous thereto ia now, - or has
ever been, thz residence of the Mortgagor or the Nbrtgagc~r's family.
32. Severability arid Savings Clauses.
(a) If any provision of this Nbrtgage is held t,o be invalid or ~nenforceable by a
court of oonpetent juris3iction, the other provisions of this Mortgage shall remain in full
force and effect and sha11 be liberally oonstrued in fawr of Nbrtgagee in order to effect
the provisions of this t~brtgage.
(b) Notwithstanding any other provision of this or any other ciocument to the
contrary, in rx~ event shall the applicable interest rate as defined in the Note secured
hereby, or in this Nbrtgage exc~ed the maximum rate of interest permitted by applicable
law.
