This action was heard on August 1, 1983, on Defendant
Southeast Bank's Motion to Dismiss Second Amended Complaint.
The Court finds that Count II of Plaintiff Turtle Reef's
Second Amended Complaint fails to state a cause of action
against Defendant Southeast Bank. Plaintiff Turtle Reef has
declined to seek leave to amend or otherwise to plead further
against Defendant Southeast Bank. It is, therefore,
ORDERED AND ADJUDGED that Count II of Plaintiff Turtle
,
' Reef's Second Amended Complaint is dismissed for failure to
state a cause of action and that Plaintiff Turtle Reef's claim
against Defendant Southeast Bank is dismissed with prejudice.
