hereby granted unto GRANTEE, its successors and assiqns, as
appurtenant to the land of the GRANTEE and those likelv situa-
ted and everv nart of it.
It is understood that the easement is given upon
the express understanding and condition that it may be used by
GRANTORS, their heirs, personal representatives, and assigns
in conjunction with the use of GRANTEE, its successors and
assigns.
It is further understood that GRANTORS, their heirs,
assigns and tenants in no way will be bound to improve, main-
tain or construct a roadway or to keep it in repair, nor do
GRANTORS, their heirs and assigns,assume any liability or
responsibility to GRANTEE, its successors and assigns, others
! likely situated, their heirs and assigns or any person using
the land by invitation, expressed or implied, or by reason
of any business conducted with GRANTEE, its successors and
! assigns or otherwise.
; GRANTEE shall have the right and obligation to build,
~ construct, improve and maintain in a proper state of repair,

~ free from potholes, a paved road within said thirty foot ease-
~
; ment provided however that in doing so, GRANTEE shall relocate
; all fill and spoil from the easement to any site on GRANTORS'
~ property adjacent to the south-selected by GRANTORS. In con-
~
~ structing the paved road on said easement, GRANTEE agrees not
~

` to disturb the existing drainage pattern on GRANTORS' grove on

F the property adjacent to the south. GRANTEE agrees to construct
~ ~

the paved road on the easement within six months from the date

of this Easement and in the event GRANTOR does not construct
" said paved road within said six month period, then this Easement
. shall be null and void and shall automatically terminate.
The limited purpose of this Easement is to permit
GRANTEE to remove sand from lands located east of GRANTORS'
3 property described in the Easement. This Easement is limited in

~ time and shall automatically expire on September 1, 1993, or when
GRANTEE ceases to mine and remove sand from GRANTEE'S property
