such taxes, family allowances, feee of attorneys and personal
repreaentattves, .r~nd court coets ehall be first charqed aqainst
lncome of the estate and then against the principal. I further
direct that income from the asaets of my estate after n~y death
~ and before distribution, includfnq income from property uaed to
discharqe liabilities, shall. not be distributed to .specific
devisees but shall become and be a part of my residuary estate
and shall be used in the payment of expenses incurred in connec-
tion with the settlement of ~ my estate and shall become and be ~ a
part of my-residuary estate for purposes of distribution.
~ • FOURTH: I may leave a written statement or list disposinq
' of certain items of my tanqible personal property not otherwi.se
disposed of in this Wil.l. Any such statement -or list in exis-
tence at the time of my death shall be determinative with respect .
to all items devised therein. All items not effectively devised
therel~y and not specifically devised in this Will, I devise to my
residuary devisees. If no written statement or list is found and
properly identified by my Personal Representative within thirty
(30) days after his qualification, it shall be preswned that
there is no such statement or list and any subsequent2y dis-
covered statement or list shall be iqnored.
~ FIFTH: In the event my wife, ELEANOR T. COLEAN, and I
should perish in a common accident or disaster, in that event it
shall be detenained that she-survived me.
SIXTH: I qive, devise and bequeath to MARIBL MINTON, DALE
V. COLEAN, MARJORIS McFADDEN and BEN L. BRYAN, JR., as Trustees,
any qovernment bonds owned by me at the time of my death; and
fu~ther direct that my Per~onal Representatives shall purchase
c~overnment bonds of the type that I presently own to brinq.the
, total face value of the bonds to Three Hundred Thousand
($300,000) Dollars, with all bonds beinq an asset of the trust
established herein. I direct that my Personal Representatives
