M FINAL JUDGMENT THIS CASE came on to be heard by the Court without a jury - and the Court having heard the testimony of the parties and their witnesses, the argument~of counsel and having taken the case under advisement, the Court makes- the following findinqs of facts. THE COURT FINDS that this is a case involving the sale and purchase of a condominium located at Ocean Dunes on Hutchinson ; Island from Ocean Dunes Development Corporation involving Unit 613 ~ of said condominium. The plaintiffs dealt with one Tony Sotolongo, i - - President of Ocean Dunes Development Corporation, who was also President of Ocean Dunes North Development Corporation. The ~laintiffs in March, 1980, purchased two (2) unites through Tony Sotolonqo in Ocean Dunes North Hutchinson Island which were ~ ~ Units 503 and 504. The plaintiffs paid a total of $35,360.00 down- ~ payment for the two condominiums, which were.never built. After ~ • F. unsuccessful attempts to get any satisfaction from Tony Sotolongo, ~ the purchaser contacted the State Attorney's Office for the Nine- ; ~ teenth Judicial Circuit and filed a complaint. Shortly thereafter, Tony Sotolongo contacted the plaintiffs and agreed to sell them ~ ` Unit 613 at Ocean Dunes of Hutchinson Island.
