9. The grantee, his leasee~or family, ia given permiasion to use for fiahing or bathing or boat~ng the
Lakes and Canala as sho~vn on Plat of Lakewood Park,•but Grantee.m~y not construct anything extend-
ing into or over the watera of the canals or lakes. No boats shall be ~anchored~ off shore in the canals or '
lakes, and when not in use shall be kept as clos~ly adjacent to the bank a~ aafety allow~ to the end that t
navigation o£ the waterwaye wi11 not be impeded. Any use of the canala or lakes ahall be at t~o sole and '
~ absolute risk of the person so using. ~
10. No filling or dredging may be done beyond any lot line, nor ahall any cutting of boat slips or ~
similar excavating ~vithin the lot line be done; nor any bulkhead or sea ~vall•~e built until plans have been
I approved by Grantor. . ~ ~
i 11. If a lot borders a canal or lake, the bed of the canaI or lake and the waters above such bed are ~
f . not irieluded.
12. Portiona of the PIAt murked "Reserved" is the private property of the Grantor and not subject to ~
thesQ conditions s+nd restrictlons aa~d the Grantor reeerves ~he right to release in whole or in part any
reatriction hereunder or #o include in any contract or deed hereafter made any additional reatrictive ~ ~
covenants providing same are not inconsistent with these herein contained, .
. 13. Any and all rig~~ts and reservatian~ oi ~he Grantar herein included may be traneferred ar t~s-
aiqned by the Grantor to a Property Owners AssociatIon or some corporate or non•carporate arganization
whose purpose it i$ to provide for the welfare of Lakewood Park. All purchasera of residence property
~ are to be automatically entitled to mambership and voting rights in an association of Owners to be form-
ed for the purpose of enforcing the convenants and maintaining the high atands~rds of Lakewood Park.
~ All o ra ahall be entitled to equal rights in the use of streets, park areas, lakes and canalg and any
other~ of property which shail be set apart by the Grantor and be Fnaintained by the Property Own••
~ ers Association when formed or a corporate or non-corporate organization. Grantee will pay $11 for I
each lot to Grantor, his nominees or assigns, on February 1, of each year, ~aid sum to be used for gen- ~ j'
~ eral maintenance, . !i
z 14. The Grantor reserves to itself the ru~as and ways ahown on the Plat referred to herein and re•
? serves the right at any time to dedicate all roads or ways ahown on Plat to public ~ae or to convey same
3 to the State. County or C3ty or any agency thereof. ~
~ I5. For the breach of any of the above reatrietions, the Grantor shall be entitled to apply for relief i~ :
# by injunction in addition to any other remedy and failure of the Grantor to enforce a reatriction herein ~
~ shall not be deemed. a wavier of a right to do so thereafter as to the same~ a prior~ or subsequent breach~~ -
and Grantor shall not be held liable for said failure to enforce any restriction herein. i,
; 16. All of the covenants and restrictions shall rsmain in force unt~l January 1~ 1958~ and ahall be
; automaticalty renewed for each 6 year period thereAfter unless owners of at least two-thirds of the lots in +
~ the development sha]l. at least six months prior to any such renewal date, agree in writing to a change in
~ ar an abrogation of any of the above covenants, and records such writing so ~mending the aforesaid
