navJgation of the waterwaya wlll not be impeded. Any use'of the canals or lakea shall be at the sole and
absolute riak oi the person so using. ,
, 10. No filling or dredging may be done beyond any lot line, nor shall any cutting of boat aiips or ~
similar excavating within the lot line be done; nor ans~ bulkhead or sea wall be t~e~iit until plan~ have been ~
approved by Grantor. • ~
11. If a lot borders a ca~al or lake~ the bed of tihe canal or lake and the waters above such bed are
• not included. ~
12. Portions of the Plat marked "Reserved" ia the private property of the Grantor and not aubject to i
these conditiona and restriction~ and the Grantor reserves the right to release in whoie or in part any ;
reatriction hereunder or to include in any contract or deed hereafter made any additional r~strietive ~ ~
covenants praviding same are not inconalstent with these h~rein contained.
73. Any and all rights and reservations of the Grantor herein included may be trans~erred or as-
~igned by the Grantor to a Property Owners Association or some corporate or non-corporate organization
whose purpose it is to provide for the welfare of Lakewood park. All purchasera of residence property
are to be automatically entitled to membership and voting rights in an associa~ion of OwnerB to be form- ~
ed for the purpose of enforeing the convenants and maintaining the high $tandards of Lakewood Park.
All owners shall be entitled ta equal rights in the use of atreets, park areas, lakea and canala and any
. other use of property which ahall be set apart by the Grantor and be maintained by the Property Own-
ers Association when formed or t~ corporate or non-corporate organization. Grantee will pay ~11 for
each lot to Grantor~ his riominees or assigne, on February Y, of each year, said sum to be used for gen-
eral maintenance,
14. The Grantor reserves to itself the roads and ways shown on the Plat referred to herein and re-
_ serves the right at any time to dedicate all roads or ways shown on Plat to public use or to convey $ame ;
to the State, County or City or any a~ency thereof. ' r:
1G. For the breach of any of the above restrictions, the Grantor shall'be entitled to apply for relief }
by injunctio~i in addition to any other remedy and failure of the Crantor to enforce a restriction herein
~ s~sall not bs deemed a wavier of a right to do so thereafter as to the same~ a prior, or subsequent breach,
and Grantor shall not be held liable for aaid failure to enforce any restriction herein.
18. All of the covenants and restrictions shall remain in force until danuary 1, 1968, and ahall be
automatically renewed for each 6 year period thereafter unleas owners of at least twathirds of the lots in ~
the development shall~ at least six months prior to any such renewal date, agree in writtng to a change in
=or an abro~ation of any of the above covenants, ana recorde aueh writing so ~mending the aforesaid ~
