HomeMy WebLinkAbout0956 prior to entry of a judgment enforcing this Mortgage if: ~ a) Borrower pays l.ender all sums which would he then due unde~ this Mortgage, the Note and notes securing ~uture Advances, ii any, had no acceleration occurred; tb) Borrower cures all breaches of any other covenants or agreeme~ts of Bo~rower contained i~ this Morlgage; (c) Borrower pa~~s all reasonable expenses incurred by Lender in enforcing the covenants and agreements of Borrower contained in this Mortgage and in enforcing Lender's remedies as provided i~ paragraph 18 hereof. including, but not limited to, reasonable attorney's fees: and (d) Borrower takes such action as Lend=r may reasonably reyuire to assure that.the lien of this Mortgage. Lender's interest in the Property and Bormwer's obligation to pay the sums secured by this Mortgage shall continue unimpaired. Upo~ such payment and curc by Borrower, this Mortgage and the obligations secured hereby shall remain in full force and effect as i( no acceleration had occurred. Z0. As additio~al security hereunder, Borrower he~eby assigr?s to Lende~ the re~ts ot the P~operty, provided that Borrower shall, prior to acceleration under paragraph 18 hereof or abandon- ment of the Property, have the right to collect and retain such rents as ihey become due and payable. Upo~ acceleration under paragraph 18 hereof or abandonment of the Properiy. Lender shall be entitled to have a receiver appointed by a court to enter upon, take possession of and manage the Propeny and to collect the rents of the Property. including those past due. All rents collected by the receiver shall be applied first to payment of the costs of management of the Property and collectio~ of rents, includi~g, but not limited to, rereiver's fees, premiums on receiver's bonds and reasonable attorney's fees. and then to the sums secured by this Mortgage. 'ifie receiver shall be liable to account only for those rents actually received. 21. Fnture Advancea. Upon requesl by Borrower. Lender, at Lender s option within twe~ty years from the date of this Mortgage, may make Future Advances to Borrower.
