COMES NO!~I the Personal Representative of the Estate of Alice Zachery, by and
through her undersigned attorney, and petitions this honorable Court to approve the
sale of real property in the Estate of Alice Zachery, and alleges:
l. The Estate of Alice Zachery consists of principally of real pro~erty
described as:
4-35-40 The East 120 feet of the West 330 feet af the
North 100 feet of the South ~t95 feet of the East one-half
of the Southeast one-quarter, St. Lucie County, Florida
2. There have been claims filed in the estate of Alice Zachery, which
claims total $13,992.33.
3. That the real property above described, was r~ot homestead oropertv and
m~.,st be sold to satisfy the claims filed in said estate. The real oronert,y above
described is located in an economically depressed area of the comrnunity and is stucco
over wood frame construction and consists of two units, one built on or about 1926,
and the other built on or about 1946.
4. The property does not meet present city code requirements and in the
event of serious damage to the structures, would require substantial new investment
to repair or replace any portion of said structures in accordance with city code.
5. The property was aparaised for estate purposes at $14,048.00 by Stanton J.
8rosilow, Realtor, a copy of which appraisal is attached to this petition.
6. The personal representative listed said pronerty for sale with the real ~
estate firm of Stanton J. Brosilow, subject to court approval on any contract aroduced
by the listing realtor. Said property was handled on multi~le listing and the real
estate firm of E7ston Real Estate produced a contract to ourchase said oro~erty
~ contingent upon caurt approval for the sale price of ~19,0OO.OQ, and further contingent
upon the buyer obtaining financing within thirty days. The purchaser under said
contract would be C. Doyle Jenkins and Dixie S. Jenkins, his wife. Said contract is
attached to this petition. That realtor, Stanton J. 8rosilow, has produced a second
purchaser on identical terms and conditions as the contract attached hereto in the event ~
the first purchaser fails to qualify for financing. The second or continaent ourchaser
is Patricia B. Williams of Fort Pierce, Florida.
